1. The service
NexStore is made of the NexStore back office (stock, sales, customers, reports) and NexStore POS (the till). We host both and you use them in a web browser.
We improve NexStore over time. If a change removes a feature included in your paid plan, we tell the account owner by email before it happens.
2. Plans and billing
Your plan and its price are shown when you subscribe and on your invoices in Settings → Billing.
Fees are billed in advance for each period. If an invoice stays unpaid after we remind you, we may suspend the account until it is paid.
Periods already started are not refunded, except where the law requires it.
3. Your account and your staff
You are responsible for:
- the owner login and every staff account and POS passcode you create;
- keeping passwords and passcodes secret, and removing access for people who leave;
- everything done through your account.
We recommend turning on two-factor authentication in Settings → Security. If you think someone else has used your account, sign out the other sessions there and write to us.
4. Acceptable use
You agree not to:
- use NexStore for anything illegal, including selling goods you may not legally sell;
- try to reach another shop's data, or test or bypass our security without our written permission;
- upload malware, overload the service on purpose, or copy or resell the service.
5. Your data
The data you enter (products, sales, customers, staff) stays yours. We use it only to run NexStore for you, and you can export your reports at any time.
6. Data processing
For the personal data of your customers and staff that you put in NexStore, you are the controller and CyberNex is the processor, under the Mauritius Data Protection Act 2017 and, for shops in the European Union, the GDPR. We:
- process that data only to provide NexStore, following your instructions;
- make sure the people who can access it are bound by confidentiality;
- protect it with appropriate security measures (see the Privacy Policy);
- use only the sub-processors listed in the Privacy Policy, and tell you before adding a new one;
- help you answer requests from people exercising their rights;
- tell you without undue delay if a breach affects your data;
- delete or return the data when the service ends, as set out in section 8.
You must have a lawful reason to collect your customers' data and must tell them how you use it.
7. Suspension and closure
You can close your account at any time by writing to us.
We may suspend or close an account for unpaid invoices, a serious breach of these terms, or a security risk. Where reasonable we warn you first and give you time to fix the problem.
8. Your data after closure
After an account is closed we keep its data for 30 days so you can ask for an export. We then delete it, except records the law requires us to keep, such as billing records.
9. Availability
We work to keep NexStore available but cannot promise it will never be interrupted, for example during maintenance or an outage at one of our providers.
10. Liability
As far as the law allows, NexStore is provided as is. We are not liable for indirect losses such as lost profit or lost business.
Our total liability for any claim is limited to the fees you paid in the 12 months before it. Nothing in these terms limits liability that the law does not allow to be limited.
11. Changes to these terms
We may update these terms. The new version is published on this page with a new date, and we email the account owner about important changes. Using NexStore after a change means you accept it.
12. Law and courts
These terms are governed by the laws of the Republic of Mauritius, and the courts of Mauritius have jurisdiction.
